1. General Provisions
These Terms and Conditions govern the purchase of goods through the online store operated at www.kayonara.com (the “Store”).

The Seller is a sole trader registered under Slovak law and registered in the Trade Register of the District Office Bratislava, Slovakia.
The Seller is not a VAT payer under §4 of Act No. 222/2004 Coll. on VAT.
By placing an order, the Buyer confirms that they have read and agree to these Terms.
Definitions
Buyer means any natural person or legal entity who orders goods through the Store.
Consumer means a natural person who, when concluding and performing the contract, does not act within the scope of their business activity, trade, or profession.
2. Orders and Contract Conclusion
Product information displayed in the Store is for informational purposes only and does not constitute a legally binding offer.
The purchase contract is concluded when the Seller confirms the order by email.
The Seller reserves the right to cancel an order in cases of product unavailability, pricing errors, suspected fraud, or technical issues. If the order is cancelled after payment has been made, the Buyer will receive a full refund without undue delay.
The purchase contract is concluded for a definite period and terminates upon proper fulfillment of the obligations of both parties.
The contract is archived by the Seller in electronic form and is not publicly accessible.
The contract is concluded in the language selected by the Buyer at the time of placing the order.
3. Prices and Payment
All prices are displayed in EUR or in the local currency depending on the Buyer’s selected country or location.
The final price payable is displayed at checkout before completing the order.
The Seller is not a VAT payer under §4 of Act No. 222/2004 Coll.; VAT is not charged separately.
Payments are processed securely via Shopify and its payment providers.
Shipping costs and delivery details are governed by the Shipping Policy.
The Seller reserves the right to correct any typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, availability, or other information at any time without prior notice. In the event of an obvious pricing error, the Seller is not obliged to deliver the goods at the incorrect price and may cancel the order and refund any payment received.
4. Shipping and Delivery
Goods are delivered to the address provided by the Buyer.
The Buyer is responsible for providing complete and accurate shipping information. The Seller shall not be liable for delivery issues resulting from incorrect or incomplete address details provided by the Buyer.
Unless otherwise agreed, goods will be delivered without undue delay and no later than 30 days from the conclusion of the contract.
Risk of loss or damage to the goods passes to the Consumer at the moment the Consumer or a third party designated by the Consumer (other than the carrier) takes physical possession of the goods.

5. Right of Withdrawal (14 Days)
Consumers have the right to withdraw from the contract within 14 days from the date of receiving the goods, without giving any reason.
To exercise this right, the Consumer must send a clear statement of withdrawal to hello@kayonara.com within the 14-day period.
The Consumer must return the goods within 14 days from the date of withdrawal.
Refunds will be issued without undue delay, and no later than 14 days from the date the Seller is informed of the withdrawal. However, the Seller may withhold the refund until the returned goods are received or the Consumer provides proof of having sent them back, whichever occurs first.

6. Condition of Returned Goods
The Consumer may inspect the product after delivery but must not handle it beyond what is necessary to establish its nature, characteristics, and functioning.
If the product is used, damaged, or handled beyond what is necessary for inspection, the refund may be reduced to reflect the diminished value of the goods.
K-pop albums often include collectible items such as photo cards, posters, stickers, or other bonuses. These items form an integral part of the product.
If any of these inclusions are missing or damaged, the refund may be reduced accordingly in line with applicable EU consumer law.
7. Complaints and Warranty
The Seller is liable for defects that occur within 24 months from delivery of the goods.
Complaints must be submitted via email with order number and description of defect.
The Seller will confirm receipt of the complaint without undue delay and resolve it within 30 days.
The warranty does not cover defects caused by mechanical damage, improper use, improper handling, or normal wear and tear occurring after the goods have been received by the Consumer.
8. Data Protection
Personal data is processed in accordance with GDPR and the Privacy Policy.
9. Intellectual Property
All content available on the Store, including but not limited to text, images, graphics, logos, product descriptions, and design elements, is the intellectual property of the Seller or its licensors and is protected by applicable copyright and intellectual property laws.
The Buyer may use the content solely for personal and non-commercial purposes. Any reproduction, distribution, modification, or other use of the content without the prior written consent of the Seller is prohibited.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Slovak Republic.

The Seller reserves the right to amend or update these Terms and Conditions at any time. The updated version becomes effective upon publication on the Store’s website. The version in force at the time of the order shall apply to the purchase contract.
